what has happened recently

FEBRUARY 2023 PLANNING APPEAL WON

At Kirby Cane, Norfolk the Highway Authority argued that a setback of 0.8m for a junction was not sufficient for the proposal of expanding a quarry, despite the overwhelming evidence and design guidance available.

​

At a late stage, but prior to the appeal hearing, the Highway Authority removed their objection but without prejudicing their stance.

​

A cost application was made to the Planning Inspectorate where by the Highway Authority failed to adequately review the available evidence and instead slavishly applied irrelevant design guidance standards.

​

I am glad to say that the Planning Inspector which had an 88% record of refusal upheld both the appeal and the applications for costs.
